As we get older the mind and body weakens, and so does the ability to care for ourselves. You may find your loved ones starting to rely on you more and more as the years pass, providing not just personal care but financial care too. This arrangement should be legalized through a formal agreement which will help to protect the rights of you and your loved ones.
The Power of Attorney places a tremendous amount of trust on friends or loved one who are providing care, and the power can sometimes be abused. If you suspect this, you are able to contest a Power of Attorney and have the courts evaluate the situation to determine the best course of action. We are able to assist concerned friends and loved ones who suspect the Power of Attorney may be going unchecked and that proper care and financial governance are being monitored appropriately. It is important to note that a person is only capable of giving a Power of Attorney if the person understands whether the proposed attorney has a genuine concern for their welfare.

Creating, Updating, & Contesting a WillList Item 2
Meticulous planning goes into creating a Will. Everything needs to be well documented to ensure your loved ones are protected after you pass. A well organized Will will ensure your assets, property, and estate are distributed in accordance with your wishes. However, providing details on every aspect of your life can take time and a lot of thought, so it is best to start the process as early as possible.
It is important to note that a Will cannot be created when the creator is incapable or under duress. A Will must be signed by the creator of the Will, in the presence of 2 witnesses (who are not beneficiaries of the Will), and must be in accordance of the Succession Law Reform Act. Wills can be updated at anytime and when a new Will is created, any former Wills may be revoked or invalid. We are also able to provide support for Memorandum of Wishes or Memorandum of Direction, Appointment of Executor and Trustee, Bequests and Devises, Residue, Guardians of minor children, Trusts, Administrator Powers of Trustees, & Changes to an Existing Will.
